  1. Can I come to Dubai on a visit or tourist visa, find work and start working immediately?

Under recent legislation pertaining to employment visas, after you are hired by Dubai employers, you need to exit the UAE and then go through the Dubai employment visa process.

You need to beware of employees who want you to work immediately without going through the Dubai employment visa process first. If you choose to begin work without a valid Dubai employment visa, then you would face the following consequences.

  • You give up your right to use the UAE Labour Code. You cannot have the Labour Ministry to mediate your case in the event of a dispute with your employer as well.
  • You would have the risk of being caught, fined and deported. You will also be blacklisted so that you might never return on an employment visa to the UAE. In many cases, illegal workers spend jail time before deportation.

 

  1. Can I go through the Dubai employment visa process myself?

No, you can’t go through the process on your own. Employment and residency in Dubai is based on a system of sponsorship. It is the employer who would need to deal with Dubai employment visa process and they apply for an employment and residency visa for the employees they hire from abroad.

  1. What is UAE’s system of sponsorship?

According to laws of the UAE, An employee’s sponsor for residency visa is their employer. In such cases, the Dubai or UAE residency visa is temporary and normally valid for three (3) years but they can be renewed. The visa would be stamped on the face of your passport.

UAE Laws require resident foreign nationals to be primarily sponsored by a UAE national. UAE nationals may be direct private sponsors. For example, a UAE national is hiring a domestic servant. There can be indirect sponsors, like in the case of business employees.

  1. Can I acquire permanent residency in the UAE?

No, you can’t.  Even if you have gone through the Dubai employment visa process successfully, you can get permanent residency as it is not allowed in the first place. Residency in the UAE is only temporary. However, the term of residency can be renewable.

  1. Can I acquire UAE citizenship after going through Dubai Employment Visa Process?

Unfortunately, you can’t do that either.  An expatriate from a foreign land is not eligible for UAE citizenship. According to the laws, UAE citizens are only those persons who are born of parents who are both UAE citizens or are born to a father who is a UAE citizen.

  1. How do I transfer sponsorship from one employer to the next?

To transfer sponsorship, your limited labour contract must have already expired.  If you have an unlimited labour contract, then you must have performed at least one year of service. Your current sponsor is required to issue a No Objection Certificate (NOC). The NOC is needed for the transfer of your Labour Card and both of them must be filed with the Department of Labour. Along with that, you must note that you can only transfer sponsorships under the same labour category. This means your new employment must be for the same position. For example, it should be from Manager to Manager.

  1. What is the NOC? Is my current employer legally bound to provide this document?

A No Objection Certificate (NOC) is necessary for the Dubai employment Visa process. It is basically a formal letter by your current sponsor addressed to the Department of Labour and the Department of Naturalisation and Immigration. It should say that your employer has no objection to your seeking of employment in Dubai or elsewhere in the UAE. This prevents you from getting banned after completion of your labour contract.

Giving the NOC is entirely discretionary and must be freely given by an employer. No employer may be forced, neither are they legally bound to provide an employee with a NOC, under any circumstance, even after successful completion of a labour contract.
